1. Introduction
The THATPainterLady Sweepstakes (“Sweepstakes”) is hosted by THATPainterLady.Com, Parent Company – Chameleon Computer Services Inc., 340 W 32nd St. #153, Yuma AZ 85354. Four (4) winners will be selected in a random drawing from among all entries received in the Sweepstakes. The odds of winning depend on the number of entries received during the Promotion Period, as defined below. The Sweepstakes is offered electronically, via the Internet and only within the 48 contiguous United States and the District of Columbia, except where otherwise prohibited by law.

2. How to Enter
The Sweepstakes begins at 8:01 AM MST on November 17, 2008 and ends at 11:59 PM MST on December 6, 2008 (the “Entry Period”). To enter the Sweepstakes, visit THATPainterLady,

LIMIT: Entrants may enter only once. THATPainterLady, Sponsors and Promoters are not responsible for incorrect or inaccurate transcription of entry information, late, lost, stolen, illegible, incomplete, misdirected, or postage due entries, or entries received through impermissible or illegitimate channels. Additionally, THATPainterLady, Sponsors and Promoters are not responsible for any human error, lost/delayed data transmission, or omission, interruption, deletion, problems or technical malfunction of any telephone network or lines, computer online systems, servers, or providers, computer equipment, software, or injury or damage to any computer related to or resulting from participation or downloading any materials in the Sweepstakes. THATPainterLady reserves the right, in its sole discretion, to cancel or suspend the Sweepstakes should virus, bugs, unauthorized human intervention, or other causes beyond the control of the THATPainterLady or Promoters, in THATPainterLady’s sole opinion, corrupt the administration, security, fairness, integrity, or proper operation of the Sweepstakes. In the event of cancellation, THATPainterLady may elect to award the prizes to winners drawn from among all participants who have played the Sweepstakes at the time of cancellation. Any attempt by an entrant to deliberately damage THATPainterLady’s or any Promoter’s Web site or undermine the legitimate operation of this Sweepstakes may be a violation of criminal and civil laws and, should such an attempt be made, THATPainterLady and Promoters reserve the right to seek damages from any such person to the fullest extent permitted by law.

3. Eligibility
The Sweepstakes is open to legal U.S. residents 18 years of age or older at the time of entry, that are legal resident of the Eligibility Area. Void in overseas U.S. territories, possessions, commonwealths and military installations, and where prohibited by law. Employees, officers and directors of THATPainterLady, Sponsors and Promoters, their respective parents, subsidiaries, and agents, their immediate families (defined as parents, spouses, children, siblings and grandparents) and those with whom such persons are domiciled are NOT eligible. Any prize won by a minor will be awarded to minor’s parent or legal guardian. By participating, entrants agree to abide by these Official Rules, including all eligibility requirements, and the decisions of THATPainterLady. All of THATPainterLady’s decisions are final and binding in all respects. In the event of a dispute as to the identity of an online entrant, entries made online will be deemed made by the authorized account holder of the e-mail address submitted at the time of entry. Potential winners may be required to show proof of being the authorized account holder for that e-mail address. “Authorized account holder” is defined as the natural person assigned to an e-mail address by an Internet service provider, online service provider, or other organization responsible for assigning e-mail addresses for the domain.

5. Conduct

By entering the Sweepstakes, entrants agree to comply with and be bound by these Official Rules. The Official Rules will be posted at the Sweepstakes Website throughout the Sweepstakes. Failure to comply with these Official Rules may result in disqualification from the Sweepstakes. Entrants further agree to comply with and be bound by the decisions of the judges, which will be final and binding in all respects. THATPainterLady reserves the right at its sole discretion to disqualify any individual it finds to be: (a) tampering or attempting to tamper with the entry process or the operation of the Sweepstakes or any THATPainterLady website; (b) violating the Official Rules; (c) violating the terms of service, conditions of use and/or general rules or guidelines of any THATPainterLady property or service; or (d) acting in an unsportsmanlike or disruptive manner, or with intent to annoy, abuse, threaten or harass any other person. CAUTION: ANY ATTEMPT BY AN ENTRANT OR ANY OTHER INDIVIDUAL TO DELIBERATELY DAMAGE ANY WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE SWEEPSTAKES MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS. SHOULD SUCH AN ATTEMPT BE MADE, THATPainterLady RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW.

6. Timing
The Sweepstakes Period (“Sweepstakes Period”), i.e. run-time, starts on November 17, 2008 at 8:01 a.m. MST and ends on December 6, 2008 at 11:59 p.m. MST. One (1) potential winner for each prize will be drawn on or about three (3) days from when all entries have been received on the end date of the Sweepstakes Period. The drawing (“drawing”) will be conducted by THATPainterLady or members of THATPainterLady staff.

7. Prize
One Grand Prize winner will receive a prize package that will include a DecoArt Texture paint package together with two physical versions of “Beginner Finishes” one each “Faux Brick” and “Faux Wood” produced by THATPainterLady. One (1) prize will be awarded for each prize offered in this Sweepstakes. The prize for which an entrant is eligible depends on the Creative Presentation from which the entrant was linked to these Official Rules. Accordingly, the prize(s) is listed on the appropriate sweepstakes entry page. Total retail value for prize and method of redeeming, obtaining and/or acquiring prize may also be listed on the same page. Prizes cannot be exchanged or returned for other prizes, Sponsor merchandise, or cash, or for reasons of dissatisfaction upon winner’s receipt of (non-damaged) prize(s), unless specifically stated on the prize’s entry page or at the sole discretion of the Sponsor.

8. Winning
The potential winner(s) will be announced by their first name, last name and state via THATPainterLady’s Newsletter, which is emailed to THATPainterLady Newsletter Members. Winners will also be announced by their first name, last name and state on http://www.thatpainterlady.com/that-painter-lady-give-away-november-2008/ Entrants must check THATPainterLady’s Newsletter or website to see if Entrant is the winner. If any potential winner cannot be contacted within 30 days of the first attempt, or if any potential winner fails to comply with these Official Rules, that potential winner forfeit the prize(s). Acceptance of a prize constitutes permission for THATPainterLady, Sponsors and Promoters to use the winner’s name and likeness for advertising and promotional purposes without compensation, unless prohibited by law.

9. Privacy
THATPainterLady does not sell its Member list. NOT EVER. Entrants’ may choose to sign up with the Sponsors who are providing the prizes for the sweepstakes should they choose.
10. Additional Terms
This Sweepstakes is governed by the laws of the United States. All federal, state and local laws and regulations apply. By entering, and or accepting a prize, all participants agree that (a) to release and hold harmless all and any members of THATPainterLady, Sponsors and Promoter Entities, and their respective parents, subsidiaries, affiliates, directors, officers, employees, and agents from any and all liability for any injuries, loss or damage of any kind to persons, including death, or property damage resulting in whole or in part, directly or indirectly, from acceptance, possession, misuse or use of any prize, participation in this promotion, or while traveling to, preparing for, or participating in any prize-related activity. Any winner is responsible for any applicable taxes on prize, including luxury tax if any. All entries are the property of THATPainterLady, and none will be returned. Neither THATPainterLady, Sponsors nor Promoters are responsible for any injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from downloading any material from THATPainterLady’s, Sponsor’s or Promoter’s Web site, regardless of whether the material was prepared by THATPainterLady, Sponsors, Promoter, or a third party, and regardless of whether the material is connected to THATPainterLady’s, Sponsor’s or Promoter’s Web site by a hypertext link. Participant agrees that: (1) any and all disputes, claims, and causes of action arising out of or connected with this Sweepstakes, or any prizes awarded, other than the administration of the Sweepstakes or the determination of winners shall be resolved individually, without resort to any form of class action, and exclusively by the United States District Court for the District of Arizona or the appropriate Arizona State Court located in Los Angeles County, California; (2) any and all claims, judgments and awards shall be limited to actual out of pocket costs incurred, including costs associated with entering this Sweepstakes but in no event attorneys’ fees; and (3) under no circumstances will entrant be permitted to obtain awards for and entrant hereby waives all rights to claim punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of the participant, THATPainterLady, Promoter and Sponsors in connection with the Sweepstakes, shall be governed by, and construed in accordance with, the laws of the State of Arizona, without giving effect to any choice of law or conflict of law rules of provisions (whether of the State of Arizona, or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the State of Arizona. All federal, state and local laws apply.
